Watch this video and keep it in mind the next time you hear a high-tech industry titan such as Bill Gates complain that he simply cannot find qualified American employees and therefore the country needs more H-1B visas: You'll see a panel discussion that looks like a sit-down with "the families" on The Sopranos, only instead of talking about organized crime these lawyers are discussing the ins and outs of helping employers side-step immigration law.



The objective, says Lawrence Lebowitz, vice president of marketing at Cohen & Grigsby, couldn't be more straightforward.

"Our goal is clearly not to find a qualified U.S. worker ... our objective is to get this person a green card," Lebowitz tells his audience.

And how does an employer go about doing that in light of the legal obligation to first search for a qualified American? It's all about where you search, he says.

"Clearly we are not going to find a place where the applicants are most numerous, we're going to find a place where - again we're complying with the law - and hoping and likely not to find qualified worker applicants," Lebowitz says.

And if despite looking in all the wrong places a gem of an American candidate pops up anyway?

"If someone looks like they are very qualified, if necessary schedule an interview; go through the whole process to find a legal basis to disqualify them," he says.

That's just a taste; there are lots more.

Lebowitz prefaced that first remark - the one about the objective being "not to find a qualified U.S. worker" - by saying, "this may sound funny."

Don't know about anyone else, but I didn't even crack a smile. It doesn't sound funny. It sounds like it ought to be illegal. At the very least, it sounds like Congress should be tightening the screws on current law before increasing the number of H-1Bs.

Black High School Students in Louisiana Threatened With Lynching

I supposed this is part of our ongoing "yes, you read that headline correctly" series here at the Big Con. Read ongoing coverage here.

In September 2006, a group of African American high school students in Jena, Louisiana, asked the school for permission to sit beneath a "whites only" shade tree. There was an unwritten rule that blacks couldn't sit beneath the tree. The school said they didn't care where students sat. The next day, students arrived at school to see three nooses (in school colors) hanging from the tree....

The boys who hung the nooses were suspended from school for a few days. The school administration chalked it up as a harmless prank, but Jena's black population didn't take it so lightly. Fights and unrest started breaking out at school. The District Attorney, Reed Walters, was called in to directly address black students at the school and told them all he could "end their life with a stroke of the pen."

Black students were assaulted at white parties. A white man drew a loaded rifle on three black teens at a local convenience store. (They wrestled it from him and ran away.) Someone tried to burn down the school, and on December 4th, a fight broke out that led to six black students being charged with attempted murder. To his word, the D.A. pushed for maximum charges, which carry sentences of eighty years. Four of the six are being tried as adults (ages 17 & 18) and two are juveniles....

A while ago I invited my readers to send their favorite exposés of The Big Con from this blog to their conservative friends and relatives - a failed experiment. None of us are talking politics any more with our conservative friends and relatives. Please file this one away nonetheless. The "racism isn't a problem any more" trope is a perennial in America. Next time you hear it, send them the news from Jena, Louisiana.

All-White Jury Likely to Hear Racial Fight Case in Louisiana

Jena, Louisiana: An all-white jury was seated Tuesday to hear the case against the first of the "Jena Six" - a group of black youths accused of beating a white fellow student amid racial discord at a Louisiana school.

Five women and a man will hear opening arguments Wednesday morning at the courthouse in LaSalle Parish, Louisiana, where the black population is only about 12 percent.

"I'm sure I can get a fair trial," Blane Williams, defense lawyer for 17-year-old Mychale Bell said. "You can't tell me there aren't six people in this town who won't listen fairly and do the right thing. I think people have a tendency to do the right thing."

The approaching trial had led to allegations of racism from parents of the accused, who said the original charges - attempted second-degree murder and conspiracy to commit second-degree murder - were out of proportion to the crime. The charges carry a combined sentence of 80 years.

However, prosecutors on Monday reduced the charges for Bell, the first of the teens to go on trial, to aggravated second-degree battery, which carries a sentence of up to 15 years, and conspiracy to commit aggravated second-degree battery, which carries a maximum sentence of 7 1/2 years.

It is unclear when or whether prosecutors intend to change charges for the other defendants - four still facing attempted murder and conspiracy charges, and a juvenile whose name and charges have not been made public. LaSalle Parish District Attorney Reed Walters has refused to publicly discuss the case.

Aggravated second-degree battery involves use of a dangerous weapon, according to state statutes.

But attorneys on both sides, during questioning of jurors, indicated prosecutors will try to say that something not usually thought of as a weapon - such as a ring or an ink pen - could be considered a dangerous weapon during a fight.

The racial tension began in late August in Jena - a central Louisiana town of 2,900 with about 350 black residents - after a black student sat under a tree traditionally used as a gathering spot by white students. The next month, three nooses were hanging in the tree when students arrived on campus.

"You didn't see the district attorney rush out to school to do anything about those nooses in the tree," said Caseptla Bailey, whose son, Robert Bailey Jr., also was charged in the beating. "You don't see white kids who beat up black kids charged with attempted murder. There's nothing fair going on here."

The school's principal recommended the students who hung the nooses be expelled, but they served brief suspensions instead.

On Dec. 4, Justin Barker, who is white, was attacked at school by a small group of black students. He was treated at a hospital.

Theodore Shaw also had been scheduled to go to trial this week, but his case was delayed. Trial dates for the others - Bryant Purvis, Bailey, Jones and the unidentified juvenile - have not been set.

Shaw and Bell have been held since their arrests, unable to post $90,000 (€66,865) bond.

Secret trials for terrorists, says US judge

The Australian" -- -- A TOP-RANKING US judge has stunned a conference of Australian judges and barristers in Chicago by advocating secret trials for terrorists, more surveillance of Muslim populations across North America and an end to counter-terrorism efforts being "hog-tied" by the US constitution.

Judge Richard Posner, a supposedly liberal-leaning jurist regarded by many as a future US Supreme Court candidate, said traditional concepts of criminal justice were inadequate to deal with the terrorist threat and the US had "over-invested" in them.

His proposed "big brother" solutions flabbergasted delegates at the Australian Bar Association's biennial conference, where David Hicks's lawyer, Major Michael Mori, is to be awarded honorary life membership.

"We have to fight terrorism with our strengths, and our strengths evolve around technology, including the technology of surveillance," said Justice Posner, a prolific legal scholar who sits on the US Court of Appeals for the Seventh Circuit.

"Are there terrorist plots that are at a formative stage among the large US Muslim community of two to three million people? In the 600,000 Canadian Muslim population, are there people planning attacks on the US?

"What we have to do is discover the extent of the terrorist threat to the US. There is a danger, and it demands a rethinking of some of our conventional views on the limits of national security measures.

"We should think of surveillance as preventative, not punitive. We should think of controls that have nothing to do with warrants or traditional criminal justice to prevent abuses."

Judge Posner said the US temper and culture could not sustain repeated terrorist attacks.

Melbourne QC Tim Tobin said it was a shock to hear such hard and isolationist positions coming from a judge known as a liberal thinker. While he was disturbed by the judge's proposed crackdown on US and Canadian Muslims, he suspected the sentiment would be welcomed by the Howard Government.

Judge Posner raised the prospect of secret trials as a "tailored regime" to prosecute terrorists in cases where there was a concern about classified information going public.

Queensland SC Glenn Martin said he had been "jolted" by the address: "I hope we never have secret trials in Australia."

Judge Posner said the US was "a law-saturated society where even non-lawyers tend to think ofproblems in terms of legal categories".

"Criminal justice and war are the two responses we have to terrorism. Each comes with its own legal institutions and doctrines and regimes but the struggle against international terrorism doesn't fit either very well."

He said it was "quite misplaced" to suggest national security measures in force or contemplated in the US could endanger liberty and undermine the political system. This was because governments could no longer conceal what they did: "We have a very aggressive media and a huge and complex government where many people in the government are quite willing to talk to the press."

Intelligence sources are refusing to rule out an Irish connection to a massive car bomb that was discovered in the heart of London this morning. Though at this early stage the facts are sketchy, any link to the IRA or its offshoots would re-open a can of worms concerning the MI5's role in past terror attacks, and specifically car bombings, over the last few decades in Britain and Northern Ireland.

The timing of the attempted attack coincides with new Prime Minister Gordon Brown taking over from Tony Blair just yesterday.

"The threat of terror returned to London today after a large car bomb was found in the heart of the capital," reports the Daily Mail.

"Bomb squad officers defused the 'massive' device after police investigated reports of a suspicious vehicle in the early hours."

"According to an eyewitness the door staff at the nightclub Tiger, Tiger alerted police after the car, believed to be a silver Mercedes, was driven into bins last night and the driver ran off."

"The witness said the car was being driven 'erratically' before the minor crash. The driver was not stopped."

In any criminal investigation and in particular terrorism inquiry, it is paramount to look at who has the motive and history to carry out such an attack.

It is important to stress that not every terror attack is necessarily part of some elaborate scheme or conspiracy - indeed it is usually small scale incidents such as this that are the work of lone extremists or Islamic fundamentalists who hate the west, of which Britain is inundated with.

But as the facts emerge we would be foolish to overlook the fact that the British security services were intimately involved in numerous terror attacks in Britain over the past few decades, namely car bombings, that were blamed on the IRA or its offshoots. This is particularly relevant considering that officials have refused to rule out an Irish connection in this case.

Every major IRA bombing in England and Northern Ireland has had the fingerprints of the British government and the FRU all over it.

Starting from at least the 1980's, SAS and British military intelligence agents were routinely ordered to embed themselves within violent branches of the IRA and aid terrorists in carrying out attacks. How do we know this happened? Because one of the individuals who was ordered to do so, Kevin Fulton, blew the whistle on the fact that he was told he had the Prime Minister's blessing to aid terrorists in bomb making and political assassinations.

In addition, mirroring the backdrop of the infiltration of the alleged liquid bomb plot, the August 15th 1998 Omagh bombing was allowed to proceed despite the fact that MI5 had fully infiltrated the Real IRA terror cell, knew the date of the bombing, and had tracked the terrorists' vehicle as it was driven to the bomb site. Again, in this case MI5 had one of their own agents within the bomb squad itself. In this instance, the car bombing went forward and 29 people, including two babies and nine children, were ripped apart as they shopped in a quiet market street.

Documents, lodged as part of a court action being taken against the British government by a disgruntled military intelligence agent, also revealed that an FRU (Force Research Unit) major was the officer who was the handler of the British army's most infamous agent inside the IRA -- a man code named Stakeknife.

Stakeknife is one of Belfast's leading Provisionals. His military handlers allowed him to carry out large numbers of terrorist murders in order to protect his cover within the IRA.

The London Observer further revealed some of the methods employed by the FRU in Northern Ireland, including the “human bomb” technique, which involved “forcing civilians to drive vehicles laden with explosives into army checkpoints”.

Former MI5 counter-terrorism officer David Shayler also saw documents indicating that the Israeli's bombed their own embassy in London in 1994 after a car bomb exploded outside the building in Kensington.

He also presented evidence that MI5 had foreknowledge of the 1993 Bishopsgate car bombing that was blamed on the IRA, and could have apprehended the bomb squad but let the attack go ahead.

To forget the proven history of the security service's involvement in car bombings and other terror attacks in Britain and Northern Ireland in light of this latest incident would be very naive, and as more information about the culprits behind this morning's attempted attack is released, that history is likely to become more prescient.

Bruce Fein, who served as the Associate Deputy Attorney General under Ronald Reagan, in a scathing editorial today called for the impeachment of Vice President Dick Cheney.

"Cheney has dulled political accountability and concocted theories for evading the law and Constitution that would have embarrassed King George III," he writes.

This is not the first time that Fein has taken on the Bush administration. In March 2006, Fein appeared before the Senate Judiciary Committee to testify on Senate Resolution 398, which called for the censure of George Bush over the warrantless wiretap program.

Fein said in his 2006 testimony that by authorizing the domestic spying program, President Bush sought to "cripple the Constitution’s checks and balances and political accountability."

In October 2006, Fein ripped into Bush for his "alarming usurpations of legislative prerogatives," and into the then-Republican controlled Congress for sitting idly by and "placing party loyalty above institutional loyalty, contrary to the expectations of the Founding Fathers."

With the wiretap program back in the news following this week's congressional subpoenas of the White House and the office of the Vice President, and a subsequent refusal to cooperate, Fein unleashed his highly critical philippic.

Fein details "multiple crimes against the Constitution" committed by Cheney, including the creation of military commissions, the "kidnappings, secret detentions, and torture in Eastern European prisons of suspected international terrorists," the advocation of "signing statements" to ignore pieces of legislation, and the encouragement of the use of torture.

"The vice president has maintained that the entire world is a battlefield," writes Fein, saying the vice president has used the bugaboo of terrorism to justify a shoot first, ask questions later approach to dealing with suspected terrorists, even when that includes American citizens.

Fein also touches on the hot-button warrantless wiretapping program, over which he has butted heads with the administration in the past. He argues that Cheney engineered the program and has "orchestrated the invocation of executive privilege" to conceal information about it from Congress.

In the end, Fein makes the case that "Bush has ceded vast domains of his powers to Vice President Cheney," in violation of the US Constitution.

"President Bush regularly is unable to explain or defend the policies of his own administration, and that is because the heavy intellectual labor has been performed in the office of the vice president," he concludes. "Cheney is impeachable for his overweening power and his sneering contempt of the Constitution and the rule of law."

Putin's Arctic invasion: Russia lays claim to the North Pole - and all its gas, oil, and diamonds

Russian leader Vladimir Putin has made an astonishing bid to grab a vast chunk of the Arctic, giving himself claim to its vast potential oil, gas and mineral wealth.

His audacious argument that an underwater Russian ridge is linked to the North Pole is likely to lead to an international outcry.

Some commentators have already observed it is further evidence of growing Russian assertiveness under its authoritarian president.

The Russian media trumpeted the findings of a Moscow scientific mission to the region which boasts "sensational" geological discoveries enabling the Kremlin to make the territorial claim.

Populist newspaper Komsomolskaya Pravda - a cheerleader for Putin - printed a map of the North Pole showing a "new addition" to Russia, a triangle five times the size of Britain with twice as much oil as Saudi Arabia.

The six-week mission on a nuclear ice-breaker claimed that the underwater Lomonsov ridge is geologically linked to the Siberian continental platform - and similar in structure.

The detailed findings are likely to be put to the United Nations in a bid to bring it under the Kremlin noose, and provide the bonanza of an estimated 10 billion tonnes of gas and oil deposits as well as significant sources of diamonds, gold, tin, manganese, nickel, lead and platinum.

Under current international law, the countries ringing the Arctic - Russia, Canada, the US, Norway, Denmark (Greenland) - are limited to a 200 mile economic zone around their coastlines.

Currently, a UN convention stipulates that none of these countries can claim jurisdiction of the Arctic seabed because the geological structure does not match that of the surrounding continental shelves.

The region is administered by the International Seabed Authority - the authority now being challenged by Moscow.

A previous attempt to claim the oil and gas resources beyond its 200 miles zone five years ago was rejected - but this time Moscow intends to make a far more serious submission to the U.N. Commission on the Limits of the Continental Shelf.

The head of the government-funded expedition Valery Kaminsky, director of the All-Russian Oceanic Scientific Research Institute, said he has key photographic evidence to prove the geological claims. "These are very interesting facts for the world community," he said.

Yuri Deryabin, head of the Institute of North European Countries, said: "I estimate Russia's chances to gets its piece of the Arctic pie highly enough - but the main battle is just starting." He acknowledged the negotiations would be "complicated".

The claim is likely to provoke an outcry from green groups but there is also Russian opposition.

Sergei Priamikov, of Russia's Arctic and Antarctic Research Institute, said the notion was "strange" and warned other countries could make counter claims.

Canada "could say that the Lomonosov ridge is part of the Canadian shelf, which means Russia should in fact belong to Canada, together with the whole of Eurasia", he observed drily.

A diplomatic source said that Russia was "seeking to secure its grip on oil and gas supplies for decades to come. Putin wants a strong Russia, and Western dependence for oil and gas supplies is a key part of his strategy. He no longer cares if his strategy upsets the West".

Iran's defense minister has described the US neocons as the main enemies of democracy who resort to inhumane acts to crush independent nations.

Brigadier General Mostafa Mohammad Najjar made the remarks at a meeting with the families of a group of Iranian high-ranking officials who were martyred in a terrorist attack in 1981.

The US-funded terrorist rings have launched tremendous attacks against Iran, including the assassination of Iranian officials on early days after the victory of the Islamic Revolution.

He also cited the attack on an Iranian passenger plane in 1988 which killed 290 passengers and crew aboard as another example of US state-terrorism.

"All the plots hatched by the enemies to rock the very foundations of the Islamic Republic were foiled through the wise leadership of the late Imam Khomeini and the heroic presence of the Iranian nation in the political arena," he added.

He said the hostile policies pursued by the US neo-conservatives against Iran were a continuation of their terrorist and inhumane measures against the Islamic nation.

"Nowadays the US public are the main victims of the warmongering and inhumane policies of this small group and are suffering financially and physically as a result of Bush administration's wrongdoings."

He reiterated that putting pressure on Iran to force the country to halt its peaceful nuclear program does not work, saying that history has proved that the Iranian nation never surrenders to the West's illegitimate demands.

Najjar said the only way out of the current crisis in the Middle East is the withdrawal of US-led forces from the region.

Iraqi Official: US 'behind Baghdad hotel blast'

An Iraqi official has accused the United States of being behind the suicide bomb that killed at least 12 in a hotel in central Baghdad.

Muhammad al-Saberi, Iraqi envoy for talks with tribal leaders in Jordan and Syria, on Tuesday held the Bush Administration responsible for the blast at the Mansour Hotel, where a group of Sunni tribal leaders from Iraq's Anbar province had gathered to discuss ways and means of curbing ongoing violence in the country.

"Because the gathering [in the hotel] was supposed to be a step toward establishing national unity among Iraqi tribes, the US, through its terrorist operatives, tried to thwart the move," IRIB quoted al- Saberi as saying.

The Iraqi official said that Washington knows full well that if security and stability come into Iraq from one door, its troops have to leave from the other and have no more pretext to prolong their stay.

"That's why the White House is at odds with bringing peace into Iraq," he observed.

Al-Saberi noted the tribal leaders including al-Ani al-Obeidi, al-Alusi, al-Joburi and al-Wazani in a reaction to the terrorist act in Mansour Hotel, had pledged in a letter they would broaden talks with the Iraqi government.

According to al-Saberi, the Iraqi government plans to put an end to continued bloodletting across the war-ravaged country via talks with Sunni tribal leaders in the west to help suppress the extremist al-Qaeda-linked militants.

On Monday a man wearing a belt of explosives walked into the Mansour Hotel 's bustling lobby around noon, approached the reception desk and detonated his bomb, killing more than 12 and injuring dozens more.

Police said among the dead was Fassal al-Guood, a tribal sheikh and former governor of western Anbar province and al-Iraqiya TV journalist Rahim al-Maliki.

Madison, WI (PRWEB) June 21, 2007 - A study of the black box data provided by the government to Pilots for 9/11 Truth has confirmed the previous findings of Scholars for 9/11 Truth that no Boeing 757 hit the Pentagon on 9/11. "We have had four lines of proof that no Boeing 757 hit the building," said James Fetzer, founder of Scholars for 9/11 Truth. "This new study by Pilots drives another nail into a coffin of lies told the American people by The 9/11 Commission":

The new society, an international organization of pilots and aviation professionals, petitioned the National Transportation Safety Board (NTSB) under the Freedom of Information Act and obtained its 2002 report on American Airlines Flight 77, a Boeing 757 that, according to the official account, hit the ground floor of the Pentagon after it skimmed over the lawn at 500 mph plus, taking out a series of lamp posts in the process. The pilots not only obtained the flight data but created a computer animation to demonstrate what it told them.

According to the report issued by Pilots for 9/11 Truth (http://pilotsfor911truth.org/), there are major differences between the official account and the flight data:

a. The NTSB Flight Path Animation approach path and altitude does not support official events.

b. All Altitude data shows the aircraft at least 300 feet too high to have struck the light poles.

c. The rate of descent data is in direct conflict with the aircraft being able to impact the light poles and be captured in the Dept of Defense "5 Frames" video of an object traveling nearly parallel with the Pentagon lawn.

d. The record of data stops at least one second prior to official impact time.

e. If data trends are continued, the aircraft altitude would have been at least 100 feet too high to have hit the Pentagon.

As Robert Balsamo, co-founder of Pilots for 9/11 Truth, observes, "The information in the NSTB documents does not support, and in some instances factually contradicts, the official government position that American Airlines Flight 77 struck the Pentagon on the morning of September 11, 2001." The study was signed by fifteen professional pilots with extensive military and commercial carrier experience. According to James H. Fetzer, founder of Scholars for 9/11 Truth (http://911scholars.org), this result fits into the broader picture of what happened at the Pentagon that day. "We have developed four lines of argument that prove--conclusively, in my judgment--that no Boeing 757 hit the building. The most important evidence to the contrary has been the numerous eyewitness reports of a large commercial carrier coming toward the building. If the NTSB data is correct, then the Pilot's study shows that a large aircraft headed toward the building but did not impact with it. It swerved off and flew above the Pentagon."

Fetzer, who retired last June after 35 years of teaching courses in logic, critical thinking, and scientific reasoning, expressed pleasure over the Pilot's results, which, he said, has neatly resolved the most pressing issue that remained about the Pentagon. He added, "We have previously developed several lines of argument, each of which proves that no Boeing 757 hit the building," including these four:

(1) The hit point at the Pentagon was too small to accommodate a 100-ton airliner with a 125-foot wingspan and a tail that stands 44 feet above the ground; the kind and quantity of debris was wrong for a Boeing 757: there were no wings, no fuselage, no seats, no bodies, no luggage, no tail! Not even the engines were recovered, and they are practically indestructible.

(2) Of an estimate 84 videotapes of the crash, the three that have been released by the Pentagon do not show a Boeing 757 hitting the building, as even Bill O'Reilly admitted when one was shown on "The Factor". At 155 feet, the plane was more than twice as long as the 77-foot Pentagon is high and should have been visible. There are indications of a much smaller plane, but not a Boeing 757.

(3) Indeed, the aerodynamics of flight would have made the official trajectory--flying more than 500 mph barely above ground level--physically impossible, because of the accumulation of a massive pocket of compressed gas (air) beneath the fuselage; and if it had come it at an angle instead, it would have created a massive crater; but there is no crater and the official trajectory is impossible.

(4) Flying low enough to impact with the ground floor would have meant that the enormous engines were plowing the ground and creating massive furrows; but there are no massive furrows. The smooth, unblemished surface of the Pentagon lawn thus stands as a "smoking gun" proving the official trajectory cannot be sustained.

Members of Scholars have contributed to a new book that analyses the government's official account, according to which 19 Islamic fundamentalists hijacked four commercial airliners, outfoxed the most sophisticated air-defense system in the world, and committed these atrocities under the control of a man in a cave in Afghanistan. Entitled, THE 9/11 CONSPIRACY (2007), it includes photographs of the hit point before and after the upper floors collapsed, the crucial frame from the released videos, and views of the clear, smooth, and unblemished lawn.

"Don't be taken in by photos showing damage to the second floor or those taken after the upper floors collapsed, which happened 20-30 minutes later," Fetzer said. "In fact, debris begins to show up on the completely clean lawn in short order, which might have been dropped from a C-130 that was circling above the Pentagon or placed there by men in suits who were photographed carrying debris with them." The most striking is a piece from the fuselage of a commercial airliner, which is frequently adduced as evidence.

James Hanson, a newspaper reporter who earned his law degree from the University of Michigan College of Law, has traced that debris to an American Airlines 757 that crashed in a rain forest above Cali, Columbia in 1995. "It was the kind of slow-speed crash that would have torn off paneling in this fashion, with no fires, leaving them largely intact." Fetzer has been so impressed with his research he has invited Hanson to submit his study to Scholars for consideration for publication on its web site, 911scholars.org.

"The Pentagon has become a kind of litmus test for rationality in the study of 9/11," Fetzer said. "Those who persist in maintaining that a Boeing 757 hit the building are either unfamiliar with the evidence or cognitively impaired. Unless," he added, "they want to mislead the American people. The evidence is beyond clear and compelling. It places this issue 'beyond a reasonable doubt'. No Boeing 757 hit the Pentagon."


Murdoch Has Flattered Communist Party Leaders And Done Business With Their Children

Many big companies have sought to break into the Chinese market over the past two decades, but few of them have been as ardent and unrelenting as Rupert Murdoch’s News Corporation.

Mr. Murdoch has flattered Communist Party leaders and done business with their children. His Fox News network helped China’s leading state broadcaster develop a news Web site. He joined hands with the Communist Youth League, a power base in the ruling party, in a risky television venture, his China managers and advisers say.

Mr. Murdoch’s third wife, Wendi, is a mainland Chinese who once worked for his Hong Kong-based satellite broadcaster, Star TV. Her role in managing investments and honing elite connections in China has underscored uncertainties within the Murdoch family about how the family-controlled News Corporation will be run after Mr. Murdoch, 76, retires or dies.

Regulatory barriers and management missteps have thwarted Mr. Murdoch’s hopes of big profits in China. He has said his local business hit a “brick wall” after a bid to corral prime-time broadcasting rights fell apart in 2005, costing him tens of millions of dollars.

But as he seeks to buy Dow Jones, the parent company of The Wall Street Journal, his track record in China has attracted attention less because of profits and losses than for what it shows about his management style.

Mr. Murdoch cooperates closely with China’s censors and state broadcasters, several people who worked for him in China say. He cultivates political ties that he hopes will insulate his business ventures from regulatory interference, these people say.

In speeches and interviews, Mr. Murdoch often supports the policies of Chinese leaders and attacks their critics. A group of China-based reporters for The Journal accused him in a letter to Dow Jones shareholders of “sacrificing journalistic integrity to satisfy personal and political aims,” a charge the News Corporation denies.

His courtship has made him the Chinese leadership’s favorite foreign media baron. He has dined with former President Jiang Zemin in the Zhongnanhai leadership compound in Beijing and repeatedly met other members of the ruling Politburo in Beijing, New York and London. Television channels affiliated with Mr. Murdoch beam more programming into China than any other foreign media group.

“The reality is that the Chinese government is not going to let anything radical happen in media,” says Gary Davey, an Australian who once ran Star TV for Mr. Murdoch. “But we got a lot farther than anyone else did.”

News Corporation officials in Beijing and Hong Kong declined to comment for this article. After The New York Times began a two-part series on Monday about how Mr. Murdoch operates his company, the News Corporation issued a statement:

“News Corp. has consistently cooperated with The New York Times in its coverage of the company. However, the agenda for this unprecedented series is so blatantly designed to further the Times’s commercial self interests — by undermining a direct competitor poised to become an even more formidable competitor — that it would be reckless of us to participate in their malicious assault. Ironically, The Times, by using its news pages to advance its own corporate business agenda, is doing the precise thing they accuse us of doing without any evidence.”

China has never been a make-or-break proposition for the News Corporation, since its operations here represent a small part of the company, which is valued at $68 billion. But Mr. Murdoch pushed for nearly 15 years to create a satellite television network that would cover every major market in the world, including China.

He coveted the $50 billion in ad spending that flows mainly to China’s state-owned news media whose products, even after years of improvements, still reflect propaganda directives as well as consumer demand.

The News Corporation’s competitors in television and film, the Walt Disney Company, Viacom and Time Warner, also had to accommodate Chinese demands as the price of admission to the local market.

But Mr. Murdoch gave more, his associates said.

“The Chinese discovered that Rupert was a real emperor who controlled everything himself,” said H. S. Liu, who oversaw government relations for the News Corporation in China. “His rivals had big, cautious bureaucracies that could not always deliver.”

China has long meant more than business to the Murdoch clan. Mr. Murdoch’s father, Keith, wrote about China as a war correspondent in the 1930s. As a newspaper proprietor in Australia, he collected Ming dynasty porcelain.

When Rupert Murdoch visited Shanghai in 1997, Wendi Deng, then a junior News Corporation employee in Hong Kong, flew up to serve as his translator. Together they explored Shanghai, which was then emerging as a lively center of finance and commerce.

“He was knocked over by the place,” recalled Bruce Dover, a former China manager for Mr. Murdoch, “and by her.” Within two years, Mr. Murdoch had left his second wife, Anna Mann, and married Ms. Deng.

Clawing Back

Mr. Murdoch’s initial foray into China was disastrous. Shortly after he purchased the satellite broadcaster Star TV in Hong Kong for nearly $1 billion in 1993, he made a speech in London that enraged the Chinese leadership.

He said that modern communications technology had “proved an unambiguous threat to totalitarian regimes everywhere.” Star could beam programming to every corner of China, and Murdoch had paid a big premium for the broadcaster for that reason.

Prime Minister Li Peng promptly outlawed private ownership of satellite dishes, which had once proliferated on rooftops. Star TV faced a threat to its viability.

Chinese leaders rebuffed his attempts to apologize in person — a ban that lasted nearly four years. But he sought to placate them. One target was Deng Xiaoping, then retired but still China’s senior leader.

HarperCollins, Mr. Murdoch’s book unit, published a biography of Mr. Deng written by his daughter, Deng Rong. Although it mainly recycled propaganda about Mr. Deng, Mr. Murdoch threw an elaborate book party at Le Cirque in New York. The book sold poorly.

He also cultivated ties with Mr. Deng’s eldest son, Deng Pufang, who is disabled. Mr. Murdoch chartered a jet to ferry a troop of disabled acrobats that the younger Mr. Deng had promoted to perform abroad, according to a former News Corporation official.

Star TV overhauled its programming to suit Chinese tastes. In 1994 it dropped BBC News, which had frequently angered Chinese officials with its reports on mainland affairs.

Mr. Murdoch said the decision was made for business reasons, not political reasons. Mr. Davey, who then ran Star TV, agreed that cost was a primary consideration.

But he said he had pressed the British broadcaster to stop showing a video of a man facing down a tank outside Tiananmen Square — an indelible image from China’s crackdown on pro-democracy protesters in 1989 — during its on-air programming breaks. He said the BBC refused, calling the video a “journalistic presentation.”

“The BBC never got the sensitivities of the situation,” Mr. Davey said. “It was relentless and stupid. Neither party was too upset about ending the relationship.”

If Star was a potential threat to the one-party state, it was also a new opportunity. Chinese officials disliked Western news media coverage of China and wanted to present their own face to the world. Mr. Murdoch provided the access they wanted.

In 1996, he entered a joint venture with Liu Changle, a onetime radio host for the People’s Liberation Army who had connections with propaganda officials. Their joint news and entertainment channel, called Phoenix, beamed programs to the small number of urban households permitted to see foreign broadcasts in China. Mr. Murdoch transmitted the same programming around the world on his satellites.

Phoenix imitated the fast pace and on-the-scene reporting style popular in the West and shook up the mainland’s staid news media, which still featured well-coiffed narrators reading scripts about meetings between senior leaders held that day. But Phoenix also tended to steer clear of the most sensitive political topics and could be bombastically nationalistic.

Phoenix may have demonstrated that the Chinese news media could become more sophisticated and dynamic without threatening the party’s power. It also showed that Mr. Murdoch could be an asset.

“Officials realized he had a good intentions,” Mr. Liu said.

After Phoenix proved a hit, Ding Guangen, a hard-liner who exercised sweeping control over all Chinese news media as chief of the country’s Propaganda Department, granted Mr. Murdoch his first meeting. So did Zhu Rongji, then the prime minister.

Mr. Zhu noted that Mr. Murdoch had become an American citizen to comply with television ownership rules in the United States. He joked that if he wanted to broadcast more in China, he should consider becoming Chinese, a person who attended the meeting recalled.

Friendly Relations

The News Corporation’s outreach intensified. When Mr. Murdoch learned that China Central Television, known as CCTV, was struggling to develop a news Web site, he dispatched a team from Fox News to help design and operate one. Another News Corporation team brought People’s Daily, the mouthpiece of the Communist Party, online.

China also needed help encrypting satellite transmissions so it could develop a pay-TV service, a specialty of the News Corporation’s NDS subsidiary. NDS helped Beijing create a proprietary encryption system. It never realized sizable royalties, people who worked at the News Corporation said.

Similarly, the company brought delegations of Chinese officials to Britain, so they could study how Mr. Murdoch’s BSkyB unit had become a lucrative gateway for satellite television in Europe.

“Our thinking was that we would show off our technology and they would contract News Corporation to do the same for them,” said Mr. Dover, Mr. Murdoch’s former China manager. “Their thinking was, ‘We want this for ourselves.’ ”

“It ended being more of a giveaway,” Mr. Dover said.

In late 1998, President Jiang invited Mr. Murdoch to Zhongnanhai. The official Xinhua news agency, reporting on the session, made clear that the media baron had a new reputation.

“President Jiang expressed appreciation for the efforts made by world media mogul Rupert Murdoch in presenting China objectively and cooperating with the Chinese press over the last two years,” Xinhua said.

The Murdochs often echoed the Chinese government line. In a 1999 interview with Vanity Fair, Mr. Murdoch spoke disparagingly of the Dalai Lama, whom the Chinese condemn as a separatist. “I have heard cynics who say he is a very political old monk shuffling around in Gucci shoes,” he said.

James Murdoch, who ran Star TV from 2000 to 2003, said in a speech in Los Angeles in 2001 that Western reporters in China supported “destabilizing forces” that are “very, very dangerous for the Chinese government.” He lashed out at the Falun Gong spiritual sect, which had just endured brutal repression in China, calling it “dangerous and apocalyptic.”

The Journal won a Pulitzer Prize for its coverage of the suppression of the Falun Gong movement in 2001. Last month, seven China-based reporters for The Journal wrote a letter to Dow Jones’s current controlling shareholders arguing that the articles on Falun Gong “may never have seen the light of day” if The Journal had been owned by Mr. Murdoch.

News Corporation officials say such fears are baseless. While several reporters who worked in China for the company’s publications in the 1990s say Mr. Murdoch’s editors pressed them to tone down their coverage of delicate issues that could anger the Chinese leadership, reporters serving in such posts now say they have not come under similar pressures.

By the late 1990s, Mr. Murdoch was traveling several times a year to the country. He was often joined by Wendi Murdoch, who left her formal position in the company but continued to scout for investments in China and participate in strategy decisions there, several people who worked for the News Corporation said.

One of her roles: introducing her husband to Chinese entrepreneurs. Many of them had received business degrees in the United States, as she had at Yale.

The Murdochs invested about $150 million in half a dozen start-up Internet and telecom companies at the height of the Internet bubble between 1999 and 2001. Only one, Netcom, returned an appreciable investment profit, two former News Corporation executives said.

But one of the entrepreneurs the Murdochs befriended during the investment spree was Jiang Mianheng, the son of President Jiang. Ms. Murdoch and some other News Corporation employees argued internally that the younger Mr. Jiang could help Star distribute its broadcasts more widely, two former News Corporation executives said.

It is unclear what role, if any, Mr. Jiang played. But in 2002, the company became the first foreign broadcaster to receive “landing rights” to sell programs to cable systems in Guangdong Province, near Hong Kong.

The license came with a catch. The News Corporation again consented to transmit Chinese programs — this time, the English-language news, talk shows and cultural shows on CCTV’s Channel 9 — to the United States and Britain. Time Warner later agreed to similar terms. But the market appeared to be opening, with the News Corporation in the lead.

Prime Time

The News Corporation and its joint venture partners controlled 9 of the 31 foreign channels, including news, movies, music videos and sports, more than any other foreign media company. Officially, however, it could still reach only government and foreign compounds and luxury hotels, as well as homes in Guangdong. Mr. Murdoch wanted more.

Good news appeared to come in 2004. The authorities began allowing Chinese-foreign joint ventures to produce shows that could be broadcast locally without the restrictions that apply to overseas content.

Mr. Murdoch interpreted the order liberally. The News Corporation allied itself with a state-run broadcaster in the western province of Qinghai. The arrangement covered not only production but also distribution. Through middlemen, the News Corporation also purchased prime-time slots in 25 Chinese provinces. It had become a backdoor national broadcaster.

Aware that the venture pushed the limits of what regulators allowed, the News Corporation sought to arrange political cover, people involved in arranging the deal said. It recruited a media and stock market entrepreneur named Ding Yuchen to join the venture as a partner. Mr. Ding’s father, Ding Guangen, was the longtime propaganda chief. A second partner was the Central Committee of the Communist Youth League, considered the political power base of China’s new top leader, Hu Jintao.

In comments to News Corporation investors in early 2005, Mr. Murdoch boasted of a “new venture,” which he did not name, “where we’ll have nearly 50 percent of a prime-time channel, which will have access to well over 100 million homes.”

It did not endure. The News Corporation used Qinghai to broadcast branded shows it had produced for its own, more limited channel. When they began appearing nationally, competitors complained that Mr. Murdoch was getting special treatment.

The Propaganda Department forced the News Corporation to end its involvement with Qinghai shortly thereafter. The cost of the debacle: between $30 million and $60 million, people connected to the company at the time said.

News Corporation executives said they felt the political winds had shifted against them. President Jiang, who retired from his final post as military chief in 2004, had lost much of his day-to-day influence. President Hu’s propaganda team pulled in the reins. Mr. Murdoch said publicly that he had hit a “brick wall.”

Mr. Liu, Mr. Murdoch’s partner at Phoenix, said the Qinghai venture “is not something I would have tried” because it ran afoul of media regulations. But he said Mr. Murdoch had not lost the good will of senior officials. “They still recognize his contributions,” he said.

When Mr. Murdoch visited China late last year, he met Liu Yunshan, Mr. Ding’s successor as propaganda chief, and Liu Qi, the party secretary of Beijing and the top coordinator for the 2008 Olympics.

The News Corporation also entered an alliance with China Mobile, the state-owned company that is the world’s largest mobile communications operator. Mr. Liu of Phoenix said the move “could open a new, lucrative highway” to provide media content to China’s 480 million mobile-phone users.

Wendi Murdoch has stepped up her role in China. She plotted a strategy for the News Corporation’s social networking site, MySpace, to enter the Chinese market, people involved with the company said. The News Corporation decided to license the MySpace name to a local consortium of investors organized by Ms. Murdoch.

As a local venture, MySpace China, which began operations in the spring, abides by domestic censorship laws and the “self discipline” regime that governs proprietors of Chinese Web sites. Every page on the site has a link allowing users or monitors to “report inappropriate information” to the authorities. Microsoft, Google and Yahoo have made similar accommodations for their Web sites in China.

The Murdochs will soon be able to call Beijing home. Workers have nearly finished renovating their traditional courtyard-style house in Beijing’s exclusive Beichizi district, a block from the Forbidden City. Beneath the steep-pitched roofs and wooden eaves of freshly coated vermillion and gold, the courtyard has an underground swimming pool and billiard room, according to people who have seen the design.

Plainclothes security officers linger on the street outside. One neighbor is the retired prime minister, Mr. Zhu, who invited Mr. Murdoch to become Chinese.

Norman Mineta Speaks out again about Cheney and 9-11

Former Transportation Secretary Norman Mineta answered questions from members of 9/11 Truth Seattle.org about his testimony before the 9/11 Commission report.


Mineta says Vice President Cheney was "absolutely" already there when he arrived at approximately 9:25 a.m. in the PEOC (Presidential Emergency Operations Center) bunker on the morning of 9/11. Mineta seemed shocked to learn that the 9/11 Commission Report claimed Cheney had not arrived there until 9:58-- after the Pentagon had been hit, a report that Mineta definitively contradicted.



Norman Mineta revealed that Lynn Cheney was also in the PEOC bunker already at the time of his arrival, along with a number of other staff.













 


Mineta is on video testifying before the 9/11 Commission, though it was omitted in their final report. He told Lee Hamilton:




“During the time that the airplane was coming into the Pentagon, there was a young man who would come in and say to the Vice President…the plane is 50 miles out…the plane is 30 miles out….and when it got down to the plane is 10 miles out, the young man also said to the vice president “do the orders still stand?” And the Vice President turned and whipped his neck around and said “Of course the orders still stand, have you heard anything to the contrary!?



Mineta confirmed his statements with reporters, saying "When I overheard something about 'the orders still stand' and so, what I thought of was that they had already made the decision to shoot something down."



Norman Mineta made it clear to reporters-- who verified his quotes in written text alongside him-- that Mineta was indeed talking about a stand down order not to shoot down hijacked aircraft headed for the Pentagon.


After no shoot down took place, it became clear that Cheney intended to keep NORAD fighter jets from responding-- evidence that Cheney is guilty of treason, not negligence for allowing the Pentagon to be hit.


The idea that "the order still stands" matches up with a change in NORAD and Pentagon orders-- issued on June 1, 2001, only months before 9/11. The document revoked the default standing orders to shoot down errant or hijacked aircraft and instructed them instead to stand down until they were given orders by the President, Vice President or Secretary of Defense.

Mineta was still in the PEOG bunker when the plane was reported down in Shanksville, Pennsylvania.


"I remember later on when I heard about the Shanksville plane going down, the Vice President was right across from me, and I said, 'Do you think that we shot it down ourselves?' He said, 'I don't know.' He said, 'Let's find out.' So he had someone check with the Pentagon. That was about maybe, let's say 10:30 or so, and we never heard back from the DoD until probably about 12:30. And they said, 'No, we didn't do it.'"









Norman Mineta's Testimony Before the 9/11 Commission-- which was NOT included in the final report and which DISPUTES the Commission's timetable for Vice President Dick Cheney on 9/11  


The two hour time delay is suspicious given the Vice President's own account of the dedicated video communications available that morning, as he told it to Tim Russert of Meet the Press on September 16, 2001.



"We had access, secured communications with Air Force One, with the secretary of Defense over in the Pentagon. We had also the secure videoconference that ties together the White House, CIA, State, Justice, Defense--a very useful and valuable facility. We have the counterterrorism task force up on that net. And so I was in a position to be able to see all the stuff coming in, receive reports and then make decisions in terms of acting with it."




At a bare minimum, this confirmation by Norman Mineta is in gross contradiction to the 9/11 Commission Report and poses serious questions about the Vice President's role in ordering NORAD to stand down on 9/11.

In the meantime, the Archive has posted the original memorandum, signed by then-CIA director James R. Schlesinger, ordering the "family jewels" study and calling on CIA employees to report to him any activities "which might be construed to be outside the legislative charter of this Agency."


Washington D.C., June 21, 2007 - The Central Intelligence Agency violated its charter for 25 years until revelations of illegal wiretapping, domestic surveillance, assassination plots, and human experimentation led to official investigations and reforms in the 1970s, according to declassified documents posted today on the Web by the National Security Archive at George Washington University.

CIA director Gen. Michael Hayden announced today that the Agency is declassifying the full 693-page file amassed on CIA's illegal activities by order of then-CIA director James Schlesinger in 1973--the so-called "family jewels." Only a few dozen heavily-censored pages of this file have previously been declassified, although multiple Freedom of Information Act requests have been filed over the years for the documents. Gen. Hayden called the file "a glimpse of a very different time and a very different Agency." The papers are scheduled for public release on Monday, June 25.

"This is the first voluntary CIA declassification of controversial material since George Tenet in 1998 reneged on the 1990s promises of greater openness at the Agency," commented Thomas Blanton, the Archive's director.

Hayden also announced the declassification of some 11,000 pages of the so-called CAESAR, POLO and ESAU papers--hard-target analyses of Soviet and Chinese leadership internal politics and Sino-Soviet relations from 1953-1973, a collection of intelligence on Warsaw Pact military programs, and hundreds of pages on the A-12 spy plane.

The National Security Archive separately obtained (and posted today) a six-page summary of the illegal CIA activities, prepared by Justice Department lawyers after a CIA briefing in December 1974, and the memorandum of conversation when the CIA first briefed President Gerald Ford on the scandal on January 3, 1975.

Then-CIA director Schlesinger commissioned the "family jewels" compilation with a May 9, 1973 directive after finding out that Watergate burglars E. Howard Hunt and James McCord (both veteran CIA officers) had cooperation from the Agency as they carried out "dirty tricks" for President Nixon. The Schlesinger directive, drafted by deputy director for operations William Colby, commanded senior CIA officials to report immediately on any current or past Agency matters that might fall outside CIA authority. By the end of May, Colby had been named to succeed Schlesinger as DCI, and his loose-leaf notebook of memos totaled 693 pages [see John Prados, Lost Crusader: The Secret Wars of CIA Director William Colby (Oxford University Press, 2003, pp. 259-260.]

Seymour Hersh broke the story of CIA's illegal domestic operations with a front page story in the New York Times on December 22, 1974 ("Huge C.I.A. Operation Reported in U.S. Against Antiwar Forces, Other Dissidents in Nixon Years"), writing that "a check of the CIA's domestic files ordered last year… produced evidence of dozens of other illegal activities… beginning in the nineteen fifties, including break-ins, wiretapping, and the surreptitious inspection of mail."

On December 31, 1974, CIA director Colby and the CIA general counsel John Warner met with the deputy attorney general, Laurence Silberman, and his associate, James Wilderotter, to brief Justice "in connection with the recent New York Times articles" on CIA matters that "presented legal questions." Colby's list included 18 specifics:

1. Confinement of a Russian defector that "might be regarded as a violation of the kidnapping laws."
2. Wiretapping of two syndicated columnists, Robert Allen and Paul Scott.
3. Physical surveillance of muckraker Jack Anderson and his associates, including current Fox News anchor Brit Hume.
4. Physical surveillance of then Washington Post reporter Michael Getler.
5. Break-in at the home of a former CIA employee.
6. Break-in at the office of a former defector.
7. Warrantless entry into the apartment of a former CIA employee.
8. Mail opening from 1953 to 1973 of letters to and from the Soviet Union.
9. Mail opening from 1969 to 1972 of letters to and from China.
10. Behavior modification experiments on "unwitting" U.S. citizens.
11. Assassination plots against Castro, Lumumba, and Trujillo (on the latter, "no active part" but a "faint connection" to the killers).
12. Surveillance of dissident groups between 1967 and 1971.
13. Surveillance of a particular Latin American female and U.S. citizens in Detroit.
14. Surveillance of a CIA critic and former officer, Victor Marchetti.
15. Amassing of files on 9,900-plus Americans related to the antiwar movement.
16. Polygraph experiments with the San Mateo, California, sheriff.
17. Fake CIA identification documents that might violate state laws.
18. Testing of electronic equipment on US telephone circuits.

Ten days after the appearance of Hersh's New York Times story, DCI William Colby tells President Ford how his predecessor James Schlesinger (then serving as Secretary of Defense) ordered CIA staffers to compile the "skeletons" in the Agency's closet, such as surveillance of student radicals, illegal wiretaps, assassination plots, and the three year confinement of a Soviet defector, Yuri Nosenko.

An apoplectic Kissinger argues that the unspilling of CIA secrets is "worse than the days of McCarthyism" when the Wisconsin Senator went after the State Department. Kissinger had met with former DCI Richard Helms who told him that "these stories are just the tip of the iceberg," citing as one example Robert F. Kennedy's role in assassination planning. Ford wondered whether to fire Colby, but Kissinger advised him to wait until after the investigations were complete when he could "put in someone of towering integrity." The "Blue Ribbon" announcement refers to the creation of a commission chaired by then-vice president Nelson A. Rockefeller.

Cabinet and sub-cabinet level officials led by Kissinger discuss ways and means to protect information sought by ongoing Senate (Church Committee) and House (Pike Committee) investigations of intelligence community abuses during the first decades of the Cold War. Worried about the foreign governments that have cooperated with U.S. intelligence agencies, Kissinger wants to "demonstrate to foreign countries that we aren't too dangerous to cooperate with because of leaks."
